Terms of service

OVERVIEW
Welcome to Solea Jewelry! “We”, “us” and “our” refer to Solea Jewelry. Solea Jewelry operates this shop and website, including all related information, content, features, tools, products and services, to offer you, the customer, a curated shopping experience (the “Services”). Solea Jewelry operates on Shopify, enabling us to provide the Services.
The following terms and conditions and all policies referred to in them describe your rights and duties when using the Services.
The processing of personal data is explained in our privacy policy. Merely visiting our website does not constitute blanket consent to data processing.

Section 1 – ACCESS AND ACCOUNT

Statutory rules on legal capacity apply to orders. Information provided for order processing must be accurate and complete. Please protect your login details and inform us if you discover unauthorised access to your customer account. Your responsibility is governed by the law.

Section 2 – OUR PRODUCTS

We have made every effort to display our products and services accurately in our online shops. However, colours or product appearance may differ from the display on your screen, depending on the device you use and its settings and configuration.
Statutory requirements regarding the quality and characteristics of goods and your statutory rights for defective goods remain unaffected.
All product descriptions may be changed at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and to limit quantities offered to a person, geographical region or jurisdiction on a case-by-case basis.

Section 3 – ORDERS AND FORMATION OF THE CONTRACT

The presentation of products in the shop is not a binding contractual offer. By completing the checkout process requiring payment, you submit a binding offer to purchase. You can review and correct your information before submitting your order.

The automated acknowledgement confirms receipt of your order only and does not constitute acceptance of your offer. We first check product availability and delivery conditions. The purchase contract is formed when we accept your offer through a separate, express order acceptance by email.

Payment authorisation or reservation of the amount alone does not constitute order acceptance. For methods supporting manual capture, we capture payment only after reviewing and accepting the order. With automatic-charge methods, payment may take place earlier; if we do not accept the order, we promptly refund payments already received.

Your statutory right of withdrawal and statutory rights for defective goods remain unaffected. Our voluntary 30-day return right also applies under the return policy. The full statutory withdrawal instructions are provided on the linked page.

Section 4 – PRICES AND PAYMENT

Product prices displayed in the shop are final prices including all taxes applicable to the sale and other price components. Any additional shipping costs are displayed before you submit your order. We disclose other additional costs before the contract is formed, in accordance with legal requirements. The price shown before the order is submitted and the payment terms agreed for that order apply. Later price changes do not automatically apply to contracts already concluded. Available payment methods are displayed during checkout.

Section 5 – SHIPPING AND DELIVERY

The delivery conditions and delivery times stated for your order apply. Your statutory rights in the event of delivery delays remain unaffected. For consumer purchases, we generally bear the risk of accidental loss of or damage to goods until delivery to you or a person designated by you to receive them. The statutory exception applies if you yourself appoint a carrier whom we have not previously named.

Section 6 – INTELLECTUAL PROPERTY

Content on this website may be protected by copyright or other rights. Its use is governed by the law and any expressly granted usage rights. Rights to third-party content and trademarks remain with the respective rights holders.

Section 7 – OPTIONAL TOOLS

We may provide features or tools from third parties. We will inform you of any separate terms before their use. Your statutory rights and our statutory responsibility remain unaffected.

Section 8 – EXTERNAL LINKS

Our website may contain links to third-party offerings. The respective providers are responsible for their content and services. Our responsibility is governed by the law.

Section 9 – RELATIONSHIP WITH SHOPIFY

Our shop is technically operated on Shopify. Your seller and contracting party for purchases from Solea Jewelry is Sharif Said, trading as Solea Jewelry. Using Shopify does not restrict your statutory claims.

Section 10 – PRIVACY POLICY

All personal data we collect through the Services is subject to our privacy policy, and certain personal data may be subject to Shopify’s privacy policy. By using the Services, you acknowledge that you have read these privacy policies.
As the Services are hosted by Shopify, Shopify collects and processes personal data concerning your access to and use of the Services to provide and improve them. Data you submit to the Services is transmitted and shared with Shopify and third-party providers, who may be located in a country other than your country of residence, to provide services to you. More information about how we, Shopify and our partners use your personal data is provided in our privacy policy.

Section 11 – REVIEWS AND FEEDBACK

Reviews or other contributions you submit must not infringe third-party rights or contain unlawful content. Your copyright and personality rights are preserved. Use of your contributions is governed by the law and expressly agreed usage rights. These terms do not grant unlimited use for arbitrary advertising purposes.

Section 12 – ERRORS AND CORRECTIONS

We may correct inaccurate information on the website for the future. Changes do not automatically affect contracts already concluded. Statutory requirements apply to the correction or avoidance of declarations and the unwinding of contracts.

Section 13 – PERMITTED USE

Please use our website lawfully. In particular, distributing malware, accessing other people’s accounts or personal data without authorisation, bypassing security measures or infringing third-party rights is prohibited. These terms do not exclude uses permitted by law. Statutory requirements apply to measures taken in response to violations.

Section 14 – ACTING THROUGH REPRESENTATIVES

If you act through another person or a technical tool, statutory rules on representation and responsibility apply. Using a tool does not restrict your statutory consumer rights.

Section 15 – TERMINATION OF USE

Statutory requirements apply to the termination of contractual relationships and the suspension of customer accounts. Existing claims arising from purchase contracts already concluded and statutory withdrawal, defect and reimbursement rights remain unaffected.

Section 16 – STATUTORY RIGHTS FOR DEFECTIVE GOODS

Statutory rights for defective goods apply to our products. You may contact Solea Jewelry about defective goods. Statutory requirements and legal consequences regarding repair or replacement, price reduction, termination of the purchase contract and damages remain unaffected. We bear the costs of repair or replacement that we are legally required to bear. Your statutory right of withdrawal and statutory rights for defective goods exist independently of our voluntary 30-day return right.

Section 17 – LIABILITY

We are liable in accordance with the law. These terms do not exclude or restrict statutory liability for damage.

Section 18 – RESPONSIBILITY

Statutory provisions apply to a culpable breach of contractual or statutory duties. These terms do not impose any additional blanket obligation to indemnify or hold harmless Solea Jewelry, Shopify or third parties.

Section 19 – INVALID PROVISIONS

If a provision of these terms is invalid, statutory provisions apply, in particular Section 306 of the German Civil Code (BGB).

Section 20 – INDIVIDUAL AGREEMENTS

Individual agreements take precedence over these terms. Their interpretation is governed by the law.

Section 21 – ASSIGNMENT AND TRANSFER OF CONTRACT

Statutory provisions apply to the assignment of claims and the assumption of the contract by third parties.

Section 22 – APPLICABLE LAW AND JURISDICTION

Statutory provisions on applicable law and jurisdiction apply. These terms do not establish exclusive jurisdiction at the location of Solea Jewelry.

Section 23 – HEADINGS

Headings in this agreement are for convenience only and neither restrict nor otherwise affect these terms.

Section 24 – CHANGES TO THE TERMS AND CONDITIONS

Changes to these terms do not automatically apply to contracts already concluded. Statutory requirements apply to changes to existing contracts.
